Massachusetts hardship status: what Form M-911 pauses and what it does not

The state's version of shelving a balance. Where paying anything would leave you unable to meet basic necessities, DOR can put collection on hold. The debt remains, interest keeps running, and it is reviewed periodically.

Hardship status can be requested at any stage once a balance is being collected. DOR describes it as temporary and reviewed periodically. It pauses certain collection actions, not the debt, and the conditions attached to it continue for as long as it lasts.

The test

DOR's collections guidance defines a significant hardship as not being able to provide the basic necessities of life, such as food, clothing and shelter. If you believe you cannot make any payment at all, it says you may consider applying for temporary hardship status, and DOR will review your situation and decide whether a significant hardship exists.

It notes that people who are unemployed or receiving certain government benefits may qualify, and invites a call to its Collections Bureau to discuss eligibility.

One category is excluded outright. DOR says open businesses are not eligible for hardship. A business that is still trading and cannot pay is dealt with through a payment agreement or, where collectibility is genuinely in doubt, the settlement process.

What it pauses, and what it does not

Hardship is often described as stopping collection. That is only partly right, and the parts it leaves in place are the ones that catch people out later.

Applying

DOR says hardship can be requested online through MassTaxConnect after logging in, or by completing Form M-911, the Taxpayer's Application for Relief Due to Hardship. It also invites a call to the Collections Bureau to talk through eligibility first.

The decision rests on evidence of income and necessary expenses. Presenting that evidence clearly is most of the work: current income from every source, the essential costs of housing, food, transport, health care and the like, and what, if anything, is left. A Statement of Financial Condition is the natural way to set it out.

Where the numbers show that some payment is possible, the answer is more likely a payment agreement than hardship. The two are not in competition; they suit different facts.

  • File every new return as it becomes due
  • Pay any new taxes as they become due
  • Tell DOR about any significant change in your financial situation
  • Expect periodic review, and keep the supporting records current
  • Remember that refunds will still be intercepted and applied to the balance

How it compares with the federal version

The IRS has a close relative, currently not collectible status, which also pauses collection where paying would leave basic living expenses unmet, and also leaves the debt, interest and any lien in place.

The two are separate decisions by separate agencies on separate applications. Federal status does not carry across to the state, and a Massachusetts hardship approval does nothing for an IRS balance. They do rest on the same underlying facts, so the financial evidence prepared for one is usually most of the work for the other.

Neither is permanent by design. Both are reviewed, and both can end if income rises. Planning for what comes next, whether that is a payment agreement or the expiry of a collection period, is part of using either well.
