Who is allowed to speak to the IRS about you

Two different authorizations that are constantly confused. One lets someone act on your behalf; the other only lets them see your file. Not everyone who can prepare your return can hold the first one.

The IRS will not discuss your account with anyone who is not authorized, and processing an authorization takes time. Where a deadline is approaching, the authorization needs to be in before the work starts, not alongside it.

The two forms do different things

Form 8821 authorizes a person or firm to receive and inspect your confidential tax information for the periods you specify. That is all it does. The holder can pull transcripts, see notices and understand the account. They cannot argue with the IRS, negotiate, sign anything, or receive a determination on your behalf.

Form 2848 authorizes representation: the holder can speak for you, receive notices, present arguments, negotiate a resolution, and sign certain agreements within the authority you grant.

For a great deal of useful work — establishing what is actually owed, what has been assessed, which periods are unfiled, where the collection period stands — 8821 is enough. It is also faster and lower risk, and it does not require the holder to be eligible to practice.

Both are specific about periods and tax types. An authorization that lists the wrong quarters or omits a form type covers nothing for the periods it missed, which is a routine and avoidable problem.

Who may hold a Form 2848

Practice before the IRS is regulated, and the categories are defined rather than general.

Attorneys, certified public accountants and enrolled agents may represent taxpayers without limitation as to subject matter or IRS office. Enrolled actuaries and enrolled retirement plan agents may represent within their fields.

Beyond those, representation is limited. A return preparer who is not one of the above has, at most, limited authority in relation to a return they prepared and signed, and only before certain functions. A family member may represent an individual in limited circumstances. An officer may represent a corporation, and a partner a partnership.

The practical translation is that preparing a tax return and representing someone in a collection or examination matter are different activities with different requirements. A person may be entirely competent at the first without being eligible for the second.

What to check before signing one

The periods and the tax types. This is where authorizations most often fail: the form lists the income tax years but not the employment tax quarters, or lists the business entity but not the individual against whom a trust fund penalty is proposed.

The acts authorized, and anything you have struck out. The form permits you to limit the authority, and limiting it is reasonable.

Whether the authorization revokes earlier ones. By default a new Form 2848 revokes prior authorizations for the same matters unless you say otherwise, which can accidentally remove a previous adviser mid-matter.

And who the person actually is. The declaration on the form requires the representative to state the basis of their eligibility, and the categories are the ones above. It is a fair question to ask before signing, and the answer determines what they can actually do for you.

How this practice fits

Being direct about the boundary is more useful than a broad claim, and the boundary here is a real one.

The record work is the part that determines most outcomes and it does not require a representation authorization at all: pulling and reading account and wage transcripts, working out what has actually been assessed and when, identifying which periods are unfiled and what the IRS already holds for them, preparing those returns, reconstructing records where they are missing, separating the trust fund portion of an employment tax balance, and assembling a financial statement that is complete and documented.

That is also the work most commonly skipped, and skipping it is why proposals get rejected and why people negotiate about numbers that were never correct.

Where a matter needs someone to act before the IRS under a Form 2848 — an examination interview, an appeal, a hearing — the useful thing is to establish that early rather than discover it late. Questions about authorizing someone to act.

What is the difference between 2848 and 8821?
Form 8821 allows someone to see your tax information. Form 2848 allows someone to act for you. The second requires the holder to be eligible to practice before the IRS; the first does not.
Can my tax preparer represent me in an audit?
Only if they are an attorney, a CPA, an enrolled agent, or fall within one of the limited categories — and an unenrolled preparer's authority, where it exists at all, is narrow and tied to a return they prepared and signed. It is worth asking directly rather than assuming.
Does an authorization stop the IRS contacting me?
A Form 2848 directs correspondence to the representative and the IRS generally deals with them, but it does not prevent contact with you and statutory notices continue to be sent to your address. Deadlines run from those notices regardless.
How long does an authorization last?
Until revoked, until it is superseded, or in practice until the periods it covers are closed. Revocation is a specific step rather than something that happens by drifting away.
Can I authorize someone just to get my transcripts?
Yes, and Form 8821 is exactly that. It is often the right first step, because knowing what the IRS has assessed is the foundation of every decision that follows.
